A 46-year-old woman was left with major injuries in a San Diego car accident after she was hit by a van at a Chula Vista parking lot the evening of November 12, 2009. San Diego’s 10news reports that the woman sustained a skull fracture and was taken to an area hospital for treatment of her injuries. The woman was apparently walking in the parking lot near Broadway and Palomar Street when a 43-year-old man operating the van slowly through the parking lot, struck her. The driver has not been arrested pending an official investigation. I hope and pray that this injured woman recovers quickly and completely. I hope her injuries were not catastrophic and that she makes it through this tough time. This injured victim and her family will be in my prayers.
San Diego Pedestrian Accidents
According to California Highway Patrol’s 2007 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 84 injuries involving pedestrian accidents in Chula Vista. Countywide, 51 died and 1,068 were injured as a result of pedestrian accidents in 2007. Also, in San Diego County, car accidents claimed 268 lives and injured 14,641 people in 2007, according to the CHP report.
What Caused this Injury Accident?
This news report does not answer many questions. It’s not clear exactly where this woman was walking at the time of the collision. We also do not know what caused the driver to hit her – whether he was unable to see her because of poor lighting or whether he was impaired, distracted or negligent in some other way. If it is determined that the driver was negligent and caused the accident, he could be held liable. If a dangerous condition in the parking lot caused or contributed to the accident, then the property owner could be held liable for the victim’s serious injuries.
In such cases, victims may seek compensation to cover medical expenses, lost earnings and other related damages. An experienced San Diego personal injury attorney will be able to advise victims about their legal right and options and explain how their car insurance policy will apply to a pedestrian accident or an uninsured/underinsured driver.
